Why have a properly drafted Will?
Without a Will you will die "intestate". This means that your assets will be distributed according to rigid formulae set out in government legislation. If your Will is not properly drafted or correctly signed it may be ineffective and cause your family even more financial and emotional distress.

If you have a Will, when should you review it?
You should review your Will regularly, at least every three years, and particularly when circumstances change such as marriage, separation, divorce, on the birth of children or grandchildren, death of a beneficiary or executor.
Why should I have an Enduring Power of Attorney?
Under an Enduring Power of Attorney you may give your attorney the power to deal with all or any part of your financial, personal and health matters. You cannot appoint an attorney unless you have mental capacity, hence one should be appointed while you are healthy. A Power of Attorney is just as important as having a Will. While a Will operates on your death, a power of attorney operates during your lifetime.
Francis & Binnie Lawyers can put your mind at ease when it comes to the drawing up of your Will and Enduring Power of Attorney or Advanced Health Directive. We also offer professional advice and services for administration of deceased estates.
